After analyzing the accidents caused by electric welding in the domestic and work areas, the author found that the frequent occurrence of electric welding fire has the following reasons:

1.1 The employer's leadership and employees have a weak sense of fire safety, and they use unlicensed welders without any management, leaving hidden accidents. Judging from the accidents that have occurred, many organizations and individuals have insufficient understanding of the fire hazards associated with welding operations. They are free to use unlicensed welders for electric welding operations, and do not take any protective measures before the operation. They do not clean up after welding operations. Even if preventive work is done in a form, the work is not done thoroughly or carefully, resulting in a fire accident.

At 17:27 on April 21, 2002, a major fire accident occurred in a shoe company. The direct fire damage was 535,800 yuan. The fire was caused by the unlicensed welder Song ** who had not conducted the welding work in the paint shop. Due to safety protection, the welding slag spattered into the funnel lining at the east end of the lacquering line, igniting the paint and causing a fire. After investigation, the workshop director of the plant had to perform electric welding operations because the plant's paint shop installed an exhaust fan. Because Song ** has not received professional training, it is not known that the lacquer shop is inflammable and explosive; however, as the director of the workshop, Stone ** did not ask whether Song ** had welding qualifications, nor did it clean the site of flammable materials for safety protection. , Let it conduct welding operations, resulting in the occurrence of fire.

1. 2 Welders do not follow the rules and operate illegally, leaving hidden accidents. In the survey, we found that some welders trained by the labor department did not strictly follow the operating procedures in the welding process. There was a chance of misgivings during the welding process. They turned a blind eye to the combustibles, flammable and explosive materials around the operation site, resulting in state property. bear the loss. At 10:50 on June 30, 2002, a blast occurred on the construction site of the new No. 1 blast furnace of a steel company. The fire destroyed a blast furnace cooling tower and caused a direct fire damage of 260,000 yuan. The fire was caused by the welding slag falling into the interior of the cooling tower and the heat-dissipating material caught fire during the electric welding work at the top of the cooling tower. The construction unit that has a fire has strict fire approval procedures. The welder also has a welder certificate. However, in the operation, the welder does not follow the rules and has not taken fire protection measures. It is obvious that there is a gas pipeline not far away, and there are combustible materials below. Still holding the try-out mentality, I was lucky and led to the fire.

1. 3 Welding site management is chaotic. Article 18(2) of the "Fire Protection Law" clearly stipulates that "operating personnel such as electric welding and gas welding who have fire hazards and operating personnel of automatic fire protection systems must hold certificates for employment and strictly observe the fire safety operation regulations." All the employees of large and medium-sized enterprises are trained, and individual operators who are idle in the society are neglected to manage. There is no organization to train them, leaving hidden accidents.

1.4 National laws and regulations There are gaps in the requirements and operating procedures of welders. Fires are usually classified into three levels based on the likelihood of a fire or explosion and the degree of damage that may result. To apply for an open fire, you must go through the approval process for the fire rating. The relevant personnel should go to the site to conduct inspections and determinations, formulate safety provisions for hot work, and implement relevant fire safety measures. According to the author's experience in his work during these years, he believes that there are the following deficiencies: 1 These requirements are not listed in the regulations, but are only explained in the interpretation of the "Fire Protection Law" ordinance, written in the textbook of the training, from the perspective of jurisprudence. From the point of view of the principle of application of the law, interpretation cannot be used as a law. Administrative law enforcement cannot be used as a basis. Therefore, these requirements lack operability in execution. 2 These requirements have certain applicability to units that are more regular in fire safety management, and are less restrictive to poorly managed, small-scale units or even individual maintenance shops. 3 Some of the requirements are not specific and unclear. The rights and obligations are not clear, so that the responsibility for a fire accident after a fire cannot be determined. For example, the division principle of the three-level hot work is not clear; there is no specific department to apply for the unit or individual that approves the open fire operation; the responsibility for cleaning the on-site combustible items is not clear; check the location of the flammable and explosive materials and confirm whether it is It is unclear who can make a fuss. If these rights and obligations are not clear, in the event of a fire, the public security fire control agency cannot determine the responsibility for fire accidents in accordance with the law. The result is that these requirements are violated and there is no relevant legal liability.
