Why Is the Effect of the Air Pollution Control Law Not Satisfactory? Since its introduction in 1987, China's Law on the Prevention and Control of Atmospheric Pollution has played a significant role in addressing air quality issues. Over the years, it has contributed to reducing some types of pollution and improving environmental conditions in certain areas. However, as the country’s economy has grown rapidly, the nature and sources of atmospheric pollutants have changed dramatically. At the time of the law’s creation, there was limited understanding of the severity and evolving trends of air pollution. Moreover, recent changes in industrial activity, urbanization, and energy consumption have made the existing legal framework less effective in addressing current challenges. So why is the impact of this law not as strong as expected? One key reason is that the legislative goals and values may not fully align with modern environmental needs. According to experts from Dongguan’s environmental sector, the law originally aimed to support economic development alongside pollution control. This focus on economic growth has led to an imbalance in the legal system, making it difficult for the law to adequately protect air quality. When conflicts arise between economic interests and environmental protection, short-term economic gains often take precedence, leading to a "pollute first, clean up later" approach. This not only increases long-term cleanup costs but also causes irreversible damage to the environment. Another issue is the lack of clear and practical implementation mechanisms. The law mentions a "total emission control system," but it lacks detailed procedures for monitoring and enforcing compliance. For example, there are no specific guidelines for supervising how polluting enterprises manage their emissions. Additionally, the geographical boundaries for total control are based on administrative regions rather than environmental or meteorological factors, which makes the system inefficient and hard to enforce. Furthermore, the law does not adequately regulate fuel suppliers, despite the fact that vehicle emissions are heavily influenced by the quality of fuel used. Even if vehicles meet emission standards, using low-quality fuels can still contribute significantly to air pollution. Without strict controls on fuel quality, the overall goal of reducing pollution remains unattainable. In conclusion, while the Air Pollution Control Law laid an important foundation, its effectiveness has been limited by outdated legislative priorities, weak enforcement mechanisms, and gaps in regulating key pollution sources. To improve air quality, China must update its legal framework to better reflect current environmental challenges and ensure that all sectors—industry, transportation, and energy—are held accountable.
