Why is the Effect of the Air Pollution Control Law Not Satisfactory? Since its promulgation and implementation in 1987, China's Air Pollution Prevention and Control Law has made significant progress in reducing air pollution. However, as the economy and society have developed, the composition of atmospheric pollutants has changed significantly. At the time of the law’s introduction, there was limited understanding of the severity and evolving trends of air pollution. In recent years, with new challenges emerging, the law has not kept pace with the changes in air quality demands, leading to gaps in its effectiveness. Why is the effect of the Air Pollution Control Law not satisfactory? First, the legislative purpose and value orientation are flawed. According to environmental experts from Dongguan, the first article of the law emphasizes promoting economic development as a key objective. This focus on economic growth over environmental protection has led to an imbalance in the legal framework, making it difficult for the law to meet modern air quality protection needs. When economic development conflicts with environmental goals, short-term economic interests often take precedence, leading to a “pollute first, clean up later” approach. This not only increases long-term cleanup costs but also makes environmental damage irreversible. Second, the legal system is incomplete, and the enforcement mechanisms lack practicality. The law mentions the “total control system,” but it lacks specific procedures for implementation, such as supervision methods for pollutant discharge companies. Additionally, the areas designated for total control are based on administrative boundaries rather than geographical or environmental factors, which makes the system inefficient and hard to implement effectively. Third, there is insufficient regulation of fuel suppliers. While vehicle emissions are controlled, the quality of fuel used plays a critical role in air pollution. If vehicles meet emission standards but use low-quality fuels, the overall goal of reducing air pollution cannot be achieved. In conclusion, the current law needs to be updated to reflect modern environmental challenges, ensure stricter enforcement, and integrate more comprehensive measures that address all sources of pollution, including fuel quality and mobile emissions.
